These Terms of Use ("Terms") constitute a legal agreement between you and Notable Stories ("we", "our", or "us") governing your use of the Notable Stories iOS application ("App"). By downloading or using the App, you agree to be bound by these Terms.
This agreement is also an End User License Agreement ("EULA") as required by Apple Inc. for apps distributed through the App Store.
1. License
We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple-branded devices that you own or control, subject to these Terms and the App Store Terms of Service.
2. Subscription & Payments
Notable Stories offers a monthly subscription that provides access to story creation features:
- The subscription is billed monthly at the price shown at the time of purchase.
- Payment is charged to your Apple ID account at confirmation of purchase.
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
- You can manage and cancel your subscription in your Apple ID Account Settings.
- No refunds are provided for unused portions of a subscription period.
- Additional story credits ("Story Packs") are available as one-time consumable purchases.
3. Free Tier
The App may be downloaded and used for free to read stories that have been shared with you. Story creation requires an active subscription.
4. Acceptable Use
You agree to use the App only for lawful purposes. You must not:
- Use the App to generate content that is harmful, abusive, offensive, or inappropriate for children.
- Attempt to reverse engineer, decompile, or extract the source code of the App.
- Use the App to generate content that infringes any third-party intellectual property rights.
- Share your account credentials with others or allow others to use your subscription.
- Attempt to circumvent credit limits, subscription requirements, or any other access controls.
5. Generated Content
Stories, images, and audio generated by the App are created using AI services. You acknowledge that:
- Generated content is provided for personal, non-commercial use.
- We do not guarantee the accuracy, quality, or appropriateness of any generated content.
- You are responsible for reviewing generated content before sharing it with children.
- We reserve the right to modify or discontinue AI generation features at any time.
6. Voice Cloning
If you use the Voice Cloning feature, you represent that:
- You are recording your own voice or have explicit consent from the person being recorded.
- You will only use cloned voices for personal story narration within the App.
- You will not use Voice Cloning to impersonate, deceive, or harm others.
7. Intellectual Property
The App, its design, and its underlying technology are owned by us and protected by intellectual property laws. You retain ownership of any personal content you input into the App (such as story prompts and voice recordings).
8. Privacy
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
9. Disclaimers
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT GENERATED CONTENT WILL MEET YOUR REQUIREMENTS.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
11. Termination
We may terminate or suspend your access to the App at any time for violation of these Terms. Upon termination, your license to use the App ceases immediately.
12. Apple-Specific Terms
As required by Apple's App Store guidelines:
- This EULA is between you and Notable Stories, not Apple Inc.
- Apple is not responsible for the App or its content.
- Apple has no obligation to provide maintenance or support for the App.
- In the event of any failure of the App to conform to applicable warranties, you may notify Apple, and Apple will refund the purchase price (if any) to you.
- Apple is not responsible for addressing any claims relating to the App.
- If the App infringes a third party's intellectual property, Apple is not responsible for investigation or settlement of such claims.
- Apple and its subsidiaries are third-party beneficiaries of these Terms.
13. Governing Law
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles.
14. Changes to Terms
We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the new Terms.
